FallGuard – Terms of Use & Liability Disclaimer

These Terms of Use and Liability Disclaimer (“Terms”) govern your use of the FallGuard application (“FallGuard” or “the App”). The App and these Terms are made available by the Provider. By creating an account or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the App.

1. Nature of the App – Research and Experimental Tool

FallGuard is an experimental, research-oriented application designed for informational and educational purposes only. It analyzes camera input locally on the user’s device to identify possible fall or laydown events. You understand and agree that: FallGuard is not a medical device; FallGuard has not been reviewed or approved by any regulatory authority (such as the FDA); FallGuard does not prevent injuries, accidents, or medical emergencies; FallGuard may be incomplete, inaccurate, or unreliable; FallGuard must not be used as a substitute for human supervision or emergency response systems.
FallGuard is built using Google’s MediaPipe framework, and its performance depends in part on the behavior and limitations of MediaPipe. Detection quality may vary based on device hardware, processing power, lighting conditions, and camera quality. You understand and agree that: detection accuracy may decrease on low-performance computers or low-resolution cameras; missed detections and false detections may occur due to hardware limitations or MediaPipe behavior; FallGuard’s ability to recognize falls in dark environments requires a camera with night vision capability; the effective detection distance and field of view depend entirely on the user’s camera model, lens type, and placement; FallGuard cannot guarantee consistent operation across all lighting conditions, camera types, or device configurations. FallGuard must not be relied upon as the sole method for detecting falls or laydowns.

2. Not for Medical or Emergency Use

FallGuard is not intended for: emergency detection, emergency communication, life-safety monitoring, medical use, diagnosis, or treatment, professional or commercial monitoring services. The App must not be relied upon as the primary or sole means of monitoring any person’s safety. In any emergency or suspected emergency, you must contact appropriate emergency services (such as 911).

3. Data Processing & Privacy

FallGuard processes camera input locally on the device. FallGuard: does not record video, does not upload or transmit continuous video, does not store video on the Provider’s servers, does not stream video to any external location. Fall Snapshot If the App detects a possible fall or laydown, it may capture and send a single still photo (“Snapshot”) to the user’s linked device via cloud messaging. By using the App, you acknowledge and agree that: the Snapshot may contain identifiable images of the monitored person; it is used solely for the purpose of allowing the user to verify whether an event occurred; the Provider does not control how you store, handle, or share the Snapshot; you are solely responsible for complying with privacy, consent, and camera laws applicable in your region.

4. User Responsibilities

You are solely responsible for: obtaining all required permissions or consent from individuals being monitored, ensuring that camera usage complies with applicable laws and regulations, correctly positioning and maintaining the camera, ensuring devices have sufficient power, network connectivity, and notification permissions enabled, understanding that the App may malfunction, produce inaccurate results, or fail to detect events. You agree not to use the App in high-risk environments where failure or delay could result in injury, death, or significant harm.

5. No Warranty

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without any warranties of any kind. The Provider makes no representations or warranties, express or implied, including: accuracy or completeness of fall detection, timeliness or delivery of notifications, uninterrupted or error-free operation, absence of defects, bugs, or failures, merchantability or fitness for a particular purpose, compliance with any medical or safety standard. You use the App at your own risk.

6. Limitation of Liability

To the fullest extent permitted by law, the Provider shall not be liable for any damages of any kind, including but not limited to: personal injury or death, failure to detect a fall or event, false positives or false negatives, delayed, incorrect, or missing notifications, malfunction or failure of the App or device, loss of data or privacy breaches caused by the user’s handling of Snapshots, indirect, incidental, consequential, special, punitive, or exemplary damages. If applicable law does not allow complete exclusion of liability, the Provider’s total aggregate liability shall not exceed the total amount paid by the user for accessing or using the App, which is typically zero.

7.Indemnification

You agree to indemnify, defend, and hold harmless the Provider from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of: your use or misuse of the App, your handling, storage, or sharing of Snapshot images, your violation of these Terms, your violation of applicable privacy or recording laws.

8. Modifications and Availability

As a research and experimental project, the App may be modified, updated, suspended, or discontinued at any time without prior notice. The Provider is under no obligation to maintain, support, or update the App.

9. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of California, USA, without regard to conflict-of-law principles.

10. Acceptance of Terms

By creating an account or using FallGuard, you confirm that: you have read and understood these Terms, you acknowledge the experimental nature and limitations of the App, you accept all risks associated with its use, you agree to be bound by these Terms.
